Terms and Conditions - Local Gardener

Welcome to our Local Gardener services. By accessing or using our services, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully before engaging our services.

1. Services Provided

We offer a variety of gardening services, including but not limited to:

Landscaping and Design: Creation of garden layouts, selection of plants, and installation.
Maintenance Services: Regular mowing, trimming, pruning, and general garden upkeep.
Seasonal Services: Leaf removal, snow clearance, and preparation for seasonal changes.
Special Projects: Installation of irrigation systems, garden lighting, and other specialized tasks.

2. Payment Terms

All services are billed based on the agreed-upon rate at the time of service. Payment is due upon completion of the work unless other arrangements have been made in advance.

Accepted Payment Methods: Cash, credit/debit cards, and bank transfers.
Invoices: Detailed invoices will be provided outlining the services rendered and associated costs.
Late Payments: A late fee may be applied to overdue accounts as specified in the invoice.

3. Scheduling and Cancellations

Appointments are scheduled based on availability. We strive to accommodate all client requests; however, availability cannot be guaranteed.

Scheduling: Services must be scheduled in advance. Walk-ins may be accepted based on availability.
Cancellation Policy: 24-hour notice is required for cancellations or rescheduling. Failure to provide adequate notice may result in a cancellation fee.
Rescheduling: Clients may reschedule services subject to our availability.

4. Client Responsibilities

Clients are expected to provide a safe and accessible environment for service delivery.

Access: Ensure that our team has access to the property during scheduled service times.
Obstructions: Remove any obstacles or hazards that may impede the completion of services.
Communication: Inform us of any specific requirements or concerns prior to service delivery.

5. Liability

While we take utmost care in providing our services, certain liabilities are outlined below.

Property Damage: We are responsible for damages directly caused by our negligence. Any such incidents will be addressed promptly and remedied as necessary.
Personal Injury: We are not liable for any personal injuries sustained by clients or third parties unless caused by our direct negligence.
Force Majeure: We are not responsible for delays or failures due to circumstances beyond our control, including natural disasters, acts of government, or other unforeseen events.

6. Intellectual Property

All content related to our services, including designs, plans, and marketing materials, are the intellectual property of our Local Gardener business and may not be used without explicit permission.

7. Privacy Policy

We are committed to protecting your privacy. Any personal information collected during service provision will be handled in accordance with our Privacy Policy.

8. Governing Law

These Terms and Conditions are governed by the laws of the jurisdiction in which our services are provided. Any disputes arising from these terms will be resolved within this jurisdiction.

9. Amendments

We reserve the right to modify or amend these Terms and Conditions at any time. Clients will be notified of any significant changes, and continued use of our services constitutes acceptance of the updated terms.

10. Termination

We reserve the right to terminate services for clients who violate these Terms and Conditions or engage in behavior that disrupts our ability to provide services effectively.

10.1 Effect of Termination

Upon termination, any outstanding payments for services rendered will remain due. Additionally, we will make reasonable efforts to assist in the transition of services to another provider if necessary.

11. Miscellaneous

Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Entire Agreement: These Terms constitute the entire agreement between the client and our Local Gardener business, superseding any prior agreements or understandings.
Waiver: Failure to enforce any provision of these Terms does not constitute a waiver of that provision.

12. Acceptance

By engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
